Un jurado federal en Los Ángeles ha declarado culpable de negligencia a Jerry Boylan, el capitán el buque Conception, por la muerte de 34 personas en un incendio ocurrido en septiembre de 2019 cuando la embarcación estaba anclada frente a la isla de Santa Cruz, en California
Boylan, de 69 años de edad, encara ahora una sentencia de hasta 10 años de prisión por el incidente, ocurrido 35 kilómetros al suroeste de Santa Bárbara, en el cual murieron 33 pasajeros y un tripulante. La audiencia de sentencia será el 8 de febrero.

Cuando el buque de buceo se incendió en la madrugada del día final de una excursión de tres días, había 39 personas a bordo. Las que dormían bajo el puente murieron cuando las llamas envolvieron a la embarcación y la nave se hundió a menos de 30 metros de la costa.
La Fiscalía alegó que Boylan, con una experiencia de 34 años como capitán, incurrió en negligencia porque no había asignado una guardia nocturna ni dado a sus tripulantes instrucciones para las tareas a realizar en una emergencia.
Según los investigadores, cuando Boylan se despertó en medio del humo y las llamas, hizo sonar la alarma y saltó por la borda, abandonando la nave de la que era capitán.
Los investigadores federales anunciaron en octubre de 2020 que no habían podido indicar qué causó el incendio, si bien determinaron que comenzó en un área del salón del puente mayor en la cual los buceadores habían conectado teléfonos celulares, linternas y otros aparatos con baterías.
“El capitán es responsable por todo lo que ocurra en un buque, incluida, y lo más importante, la seguridad de todas las personas a bordo de ese buque. Boylan falló totalmente en estos deberes”, dijo el fiscal federal Martin Estrada después de darse a conocer el fallo.
